伴隨著都市成長與經濟的發展,都市中會產生停車的問題,停車問題若未加以規劃管理會造成整個都市發展的阻礙,不論台灣、美國或中國大陸的城市均有此爭議,故以城市發展的角度,完善的停車系統對於都市發展是有所助益,道路周邊停車位的財產權產歸屬,會影響到使用者為何和其使用權利範疇及程度,本文以財產權角度對路邊停車系統加以討論,我國法律學說與實務皆認為,財產權為人類自由的基本權利,人民依據財產本身得於自由使用、收益並處分其合法獲得之財產,國家政府不得違法任意加以侵害,台北市的道路周遭土地,所有權屬約略分為公有及非公有,公有土地適可探討是否可撥供主管機關統一規劃運用,非公有土地亦應檢視是否加以徵收徵購之,已劃設停車位的路邊停車格有部分未收費,導致爭議與糾紛,適可調整檢視均加以收費是符合整體公共利益,且台北市相關管制規範已經年未檢視,勢有需加以整體規劃探討之。
With the growth of the city and the development of the economy, the city will have the problem of parking, if there is no planning and management will hinder the development of the city, whether it is Taiwan, the United States or mainland China cities will be affected. In the urban development, the perfect parking system is conducive to urban development. Ownership of the property on the roadside parking spaces will affect the user and his right to use. This paper studies the roadside parking system from the perspective of property rights theory. The law of Taiwan argues that property is the fundamental right of human freedom and that the people can freely use, profit and disposit their legally acquired property on the basis of property rights. The government cannot arbitrarily infringe. Taipei Road land, property rights are divided into public, private,- Public land can be reviewed whether it can be unified and planned by a competent authority.- Private land should be purchased by government review. Part of parking grid of the parking space is free for user which is unfair for another user and leads to disputes and disputes. These parking spaces should be charged for all costs in order to be fair. Finally, the laws of Taipei have not been revised for a long time and should be reviewed. |
