為研析東南亞各國之輸入食品管理之法規,食品藥物管理署近年來邀請各國官方代表來台交流,希透過國際合作與經驗分享,掌握國際輸入食品最新管理趨勢,籍以檢討我國輸入食品管理與國際規範之異同,精進我輸入食品管理措施。本研究即緣起食藥署委託綜整相關資料,將東南亞四國之輸入食品管理及查驗措施、邊境執行管理等相關規範進行探討,比較與我國輸入食品管理相關制度之差異性,提供相關領域產官學界及作為未來食品安全管理政策擬定之參考。細言之,本研究針對泰國、越南、馬來西亞、菲律賓之輸入食品邊境查驗相關法制,進行彙整與比較,目前研究成果發現各國皆有獨立食品安全權責機關,以現代風險管理概念執行食品安全政策,更重視法規完備與即時性,利用先進資訊系統使邊境查驗更加便捷精確,且國與國間之合作更為緊密。依以上發現,本計畫進一步分析各國管理與我國管理重要相異處,探討各國特殊法規制度設計,並提出建議方案,內容涵蓋增進查,臉效率、加強高科技查驗能力、加重違規者刑事責任、提供完整消費資訊等,期望使我本已優良之輸入食品安全機制,更趨完善。
This paper collects, summarizes, and compares imported food regulation and border control in Thailand, Vietnam, Malaysia, and the Philippines, focusing on pertinent laws and systems. Research findings under this paper indicate that every said country has independent food safety authorities, implements food safety policies pursuant to the modern risk-based management concept, pays more attention to complete and prompt legislation, utilizes advanced information systems to streamline government control, and reinforces transnational cooperation. Based on the findings, this paper further compares the differences in food safety management between said countries and Taiwan, analyzes unique system designs for regulation, and comes up with recommendations. The paper proposes that the government should demand proper food material health certificates, enhance traceability, strengthen use of food science and technology, improve safety management efficiency, support education in food law and enforcement, integrate into Southeast Asia's global food supply chain, conduct transnational information exchange, and study ASEAN laws for harmonization, so as to ensure imported food safety for Taiwan. |
