新住民一旦面對醫療糾紛,通譯之重要性與迫切性可以想像。本文分析通譯與病人、家屬、醫事人員與醫療機構之不同角色。並依「醫療糾紛處理及醫療事故補償法(草案)」所明定之通譯功能加以闡述。通譯之說明功能為客觀事實傳遞;溝通功能為醫病共識之促進;而關懷功能為情感交流與經驗分享。本文呼籲台灣社會須針對醫療糾紛通譯之法制化形成共識,加速對通譯進行醫療專業與跨領域知識之教育訓練,如此方可實質落實病人自主權與達到醫病關係和諧之願景。
When new immigrants face medical malpractices, interpreter's importance and urgency is not hard to imagine. This article analyzes interpreter's different role play when facing with patients, relatives, medical personnel, and medical care institutions. This article also explains interpreter's function mentioned in the “Medical Malpractice Resolution and Compensation Act (draft)". In terms of interpreter's explaining function, it means passing objective facts. In terms of interpreter's communicating function, it means facilitating consensus building between patients and physicians. In terms of interpreter's caring function, it means exchanging feelings and experiences. This article states that the Taiwanese society should build consensus about legalizing interpreter's position when facing with medical malpractices. Interpreters should take educational training related to medical profession and interdisciplinary knowledge. Thus, patients' right to autonomy can be fulfilled and harmonious physician-patient relationship goal can be achieved. |
