從區域治理觀點分析台灣醫療觀光產業之法制面建置

A Legal Construction of Taiwan's Medical Tourism Industry from a Regional Governance Perspective

本文以區域治理之新視角進行台灣醫療觀光產業法制面建構之研究。本文乃立基於台灣醫療觀光產業法制面鼓勵規範不足、台灣醫療觀光產業面臨大陸地區之拉力及創新以區域治理視角建置台灣醫療觀光產業之法制完備性三研究背景。此外，本文冀望達到政府跨部會資源整合、跨領域理論創新整合與發揮台灣醫療觀光產業之創立之三研究目的。本文運用比較法研究分析、SWOT分析法與區域治理理論為研究方法及理論背景，依據台灣七大發展生活圈設計「促進台灣醫療觀光產業發展條例（草案）」，作為政策面之參考依據。 This article attempts to use a regional governance perspective to analyze Taiwan's medical tourism's legal construction. The research background is based upon three main ones: a lack of legal regulation in encouraging Taiwan's medical tourism industry, Taiwan's medical tourism faces a pulling effect from the Mainland, and uses an innovative regional governance perspective to construct Taiwan's medical tourism's legal basis . Furthermore, this article attempts to fulfill the following goals: integrate government's resources, build up a multidisciplinary point of view in interpreting Taiwan's medical tourism, and enable Taiwan to display its creativity in Taiwan's medical tourism. This article uses comparative research analysis, SWOT analysis, and regional governance theory. Based upon the seven developing life cycles in Taiwan, a draft called “Act for The Development of Taiwan's Medical Tourism Industry＂ is going to be designed to support policy needs.
