長久以來,政府對於介入著作權集體管理團體之程度爭議不斷,有從私法自治的角度觀之,亦有從公益性角度觀之,故而不論學說見解分歧,甚至立法政策及技術均產生紊亂,造成許多爭議。本文從另一個角度面向觀之,認為應從公權力介入之界線及立法政策上之必須正視之核心問題,認為現行制度並不妥適,而應建構強制仲裁方式處理方屬上策。
This paper discuss the issues from a different prospective, which focus on the core issues of the boundaries of the public power on intervening in copyright collective management and the legislative policy. The writers believe that the existing system is not appropriate. On the contrary, mandatory arbitration is the best way to deal the issues. |
