隨著特朗普總統上臺，近期美國對華貿易政策逐步體現出單邊主義的特點。美國單邊對華發動3０1調查不僅違反WTO《關於爭端解決規則與程序的諒解》第23條，而且嚴重違背程序正義與實體正義。本質上，美國正大力推動中美經貿摩擦轉變為中美制度摩擦。然而，美國單邊貿易救濟措施必須受多邊貿易機制的約束。實際上，多邊貿易體系明確認可多元化的市場經濟體制。因此，中國應堅持以多邊貿易機制為基礎糾正美國的錯誤認識，堅持本著互利共贏的理念解決超WTO義務問題，並堅定不移地推動形成全面開放新格局，以此應對美國單邊主義的挑戰。
