Legal Perspective on “ Sino-US Trade War”

近期，由美國政府依據其《貿易法》301條款和232條款挑起的“中美貿易戰”甚囂塵上，導致兩國經貿關係變得愈發緊張，至今仍未偃旗息鼓，事態如何發展還需密切關注。目前多數評論，主要是從政治、經濟層面進行評析。本文試從法律視角對這場“貿易戰”進行概括性分析，並提出一些建議與看法，以期兩國貿易爭端能夠通過談判和平解決，使中美經貿關係得以維繫和發展。

Recently, the “Sino-US trade war” initiated by the U. S. government in accordance with Section 3O1 and Section 232 of the Trade Act of 1974 makes the economic and trade relations between the two countries become more and more tense. So far, this “war” is still going on so that the development of the situation needs close attention. At present, most comments on “Sino-US trade war” are mainly based on political and economic perspectives. This essay tries to make a general analysis from legal perspective and puts forward some suggestions and opinions, hoping the trade disputes between the two countris can be settled peacefully through negotiation in order that Sino-US economic and trade relations can be maintained and developed.
