無犯罪計劃課程處遇者再犯情形之研究

Research on Recidivism Rate of Criminals Graduated for CRIMINON Program

毒品防治，是世界各國亟欲克服的重大議題，筆者因工作之故，在臺南監獄與「無犯罪計劃課程」有所接觸，該課程以專業戒毒輔導處遇課程自居，是否真如上過課的受刑人所說的：「和其他戒毒班很不一樣」？是否可擴大推廣至各矯正機關以降低毒品犯再犯率的教化課程？實為筆者意欲探究、驗證的主題。本研究採實證研究的方式，探討無犯罪計劃課程對監獄吸毒受刑人的處遇成效。研究對象為民國100年至105年當中，參與臺南監獄無犯罪計劃課程，通過課程拿到結訓證書後出監的183位結訓男學員，進行出監後再犯調查。自變項為無犯罪計劃課程的介入；依變項為出監後再犯調查結果，並依此結果與全國矯正機關最新公布毒品再犯率做比較、與同樣執行無犯罪計劃課程的美國新墨西哥州Second Chance Center的再犯率做比較。研究結果如下： 一、無犯罪計劃課程結訓學員近五年的出監毒品再犯率為33.3%，且再犯毒品的高峰期往後遞延至出監後2-3年，此與全國矯正機關58.3%的毒品再犯率，且出監6個月內再犯率最高的狀況，確實具十分明顯的改善。 二、臺南監獄無犯罪計劃課程結訓學員出監一年的再犯率為4.6%，優於Second Chance Center的無犯罪計劃課程結訓學員出所一年的34.3%再犯率。 本研究發現，無犯罪計劃課程經過學理上的剖析，以及近幾年課程執行後的本土化調整，已臻於成熟。建議將無犯罪計劃課程推廣到全國各監所，成為各監所共通且系統性之戒毒課程。 Drug Abuse Prevention, it's an important issue every country desperate to overcome. And because of my profession, I contacted ''Criminon Program'' in Taina Prison, and the courses take itself as the professional intervention courses of drug detoxification. Is it really the same as what inmates say, ''Very different from other detoxification classes''? Does it could expand and promote into the enlightenment courses of Correctional Facilities, with effectiveness of lowering recidivism rate? Those are actually the subjects I want to explore and validate. This research is based on empirical research; discuss the intervention results of '' Criminon Program'' for drugged inmates. The subjects are 183 male students: they have participated in Criminon Program in Tainan Prison, and passed through it, got the certificate and went out of prison. The independent variable is intervention of Criminon Program; the dependent variable is the investigation result of the recidivism after prison. Then we compare the results with the latest drug recidivism rate released from national Correctional Facilities, and we also compare it to the recidivism rate of Second Chance Center located in New Mexico, America which executes Criminon Program, too. The research conclusions are: 1.The latest 5-years drug recidivism rate after prison of students completing Criminon Program is 33.3%, and the peak period of drug recidivism delays to 2~3 years after prison. Indeed, it’s obviously improved, comparing to 58.3% drug recidivism rate of national Correctional Facilities, along with its highest recidivism rate is within 6 months after prison. 2.The recidivism rate of the students completing Criminon Program in Tainan Prison after prison for 1 year is 4.6%, and it’s superior to 34.3% recidivism rate of Second Chance Center’s students after prison for 1 year. This research discovers: Criminon Program have reached into maturity, through the practical analysis and the adjustment in recent years after completing it. It’s suggested that we promote Criminon Program into each and every prison in our country, and make it the common and systematic detoxification courses all over them.
