In 1970, the territorial dispute over Tiaoyutai Islands between China and Japan came into being. To support its claim to Tiaoyutai Islands, the government of Republic of China has adduced some grounds, which are based on geography, geology, history and civilian use of Tiaoyutai Islands, and international law. Given that international law is the legal order which governs the international community, the suitable grounds for a territorial claim should be based on international law. This article will elucidate how to form the legal grounds for the territorial claim to Tiaoyutai Islands. |
