土地財產權制度執行問題與治理機制之探討──以南灣海域、社頂部落為例

Enforcement Problem of Land Property Rights Institutions and Governance Mechanisms-Case Study of Nanwan Water and Sheding Tribe

國家公園相關研究多針對規劃管制與經營管理等層面，缺少以財產權制度執行觀點，分析國家公園內非法占用之土地財產權制度執行問題。本文基於財產權理論，透過個案研究法，以半結構式訪談法與直接觀察法蒐集個案資料，探討治理機制之改變對土地財產權制度執行問題之成效。本文研究發現，個案制度接受者的土地利用行為是可移動性的，採取混合式治理型態可降低監督懲罰機制的交易成本，透過公私部門合作的制度誘因，發揮自主性調適機制，並形成合作性調適機制，然而公私部門合夥契約缺乏安全措施，衍生私部門組織團體分裂、違法擴張使用等其他土地財產權制度執行問題。 Relevant research about National Parks is more for planning control and management, but the lack of enforcement of property rights to analyze illegally occupied in national parks. Based on property rights theory, through case study which collecting information by semi-structured interview and direct observation, this study investigates how the change of governance mechanisms affect enforced effectiveness of land property rights institutions. This study found that the recipient's land use behavior is mobility. Hybrid governance model is more suited to adopt, because incentives induce autonomous adaptation mechanisms and the formation of cooperative adaptation mechanisms. However, public-private sector partnership contract without security mechanisms causes the division of private sector organizations, illegal expansive use of land property rights and other enforcement issues of land property rights institutions.
