獲利返還請求權與侵權損害賠償關係之辨

The Research on the Relationship Between the Right to Disgorgement and Tort Compensation

《侵權責任法》第20條所規定的獲利返還請求權與侵權損害賠償請求權存在密切聯繫。獲利返還請求權是為克服侵權損害賠償不足而產生的，但獲利返還請求權不能為侵權損害賠償所替代，其有獨立的理論基礎與適用條件。獲利返還請求權也不是受害人損害數額的計算方法，也不宜以是否可以賠償損害作為返還獲利的先決條件。獲利返還請求權在性質上屬於獨立的請求權類型，當事人可以選擇依據獲利返還請求權或者侵權損害賠償請求權提出請求，但二者不能同時適用。

The right to disgorgement in article 20 of Tort Law ofthe People' s Republic of China is closely connected with the right to tort compensation. The right to disgorgement is designed to overcome the inadequacy of tort compensation, but it could not be replaced by tort compensation because of its own theoretical basis and application conditions. The right to disgorgement is not method of calculation of victim's damages, and not the prerequisite to gain tort compensation. The right to disgorgement is an independent kind of right to claim. The litigant can choose to exercise the right to disgorgement or the right to tort compensation, but both rights could not be exercise simultaneously.
