試論我國失能老人監護制度之完善

A Tentative Study on the Improvement of China's Elderly Guardianship System

中國已成為世界上老齡化最嚴重的國家之一。龐大的老年人口數量給政府、社會、家庭帶來了空前的養老壓力，然而我國民事法律中有關老年人的監護或照管制度卻乏善可陳。本文著眼於老年人中更為弱勢的群體－－失能老人，從其視角來探討我國現行法律制度的缺陷和不足，並通過對其他大陸法系國家相關制度的分析比較，為我國未來的法制改革，特別是民法典相關制度的完善提供一些思路。

China is one of the countries in the wor1d facing the most serious aging problem. The huge number of elders has put enormous pressure on our government, society and families. However, regulations of the elderly guardianship or care in Chinese civil law system are quite immature. This paper intends to discuss the defects and shortage of our current guardianship legal practice with a focus on the more fragile group among the elders, the disabled elders, thus contribute to the legal reform of our future system, in particular, the legislation of our civil code by way of comparative analysis to the counterparts of other civil law countries.
