信息披露與中藥商業秘密保護

The Coordination between the Information Disclosure and the Protection of Trade secrets in Traditional Chinese Medicine

在藥品的智慧財產權保護體系中，中藥與西藥的差異使專利制度逐漸凸顯出在中藥領域保護效用的不力，相形之下，商業秘密的現實優勢使其在該領域有廣闊的適用空間。但是在運行過程中，基於公眾健康安全的維護和公共利益抗辯規則的適用，中藥商業秘密面臨著信息披露與公開的壓力。矛盾的存在會動搖商業秘密制度生存的根基，而解決之道則在於釐清公共利益與私人利益之間的價值選擇關係，並在具體的制度設計中有效劃分信息的邊界及利益相關者的層次，以實現相關信息向適當利益之人的披露，維護中藥商業秘密的正當性。

In the intellectual property system in pharmaceuticals, the characteristics of Traditional Chinese medicine (TCM) makes it's difficult to be properly protected by patent system. While the system of trade secrets fits it well. It can give enough protection to TCM and should be applied broadly. But in this process, the system of trade secrets on TCM faces the big challenge form the rules of the public-interest defence, due to the need of protecting the public health. Whether the related information should be disclosed or protected is in controversy, which will shake the foundation of trade secrets. In order to find the effective solution, we should balance the interests between public and individuals, disclose the different information to different subjects. This kind of limited disclosure is helpful to both the public and the private, and it will do good to the development of the system of trade secrets in TCM.
