The Connotation and Denotation of Rule 40 of the Patent Law

專利法實施細則第40條針對遺漏說明書附圖的缺陷提供了一種救濟機制，涉及重新確定申請日。本文結合國家法和國際法中的相關規定，探討了細則第40條的立法原意，提出了申請日的確定原則為影響申請日確定的“最低限度申請文件的齊備之日”，明確了細則第40條規定的重新確定申請日與專利法第33條無關，並針對說明書附圖以及說明書不齊備的幾種實踐中常遇到的相關情形進行分析，給出了具體的建議。

Rule 40 of the patent law provides a way of making up for missing part of drawings, which involves the change of filing date. With the related content of inland patent law and international patent law, it discussed the legislation background of Rule 40, provided an idea that the determination of filing date was based on the integrity of the necessary application documents, affirmed that Artic1e 33 of the patent law had nothing to do with Rule 40 of the patent law, and gave some advice on the missing part of description or drawings.
