論ODR平臺的多元規制系統

A Polysystem of regulation on ODR platform

在“互聯網+”的浪潮中，傳統的替代性糾紛解決機制(ADR)，不僅被嵌入互聯網這一基因，而蛻化成為線上糾紛解決機制(ODR)，還被注入資本的血液，而成長為線上糾紛解決平臺（ODR平臺）。兩類高度活躍的因素，讓ODR平臺在提供高效解紛服務的同時，也同時帶來了新型的風險。本文筆者以ODR平臺的上述兩大類性質為基礎，分析ODR平臺二維度風險，並在此基礎上主張構建一個多元規制系統，以實現自由與安全的平衡。

In the wave of 'Intemet + ', the traditional Altemative Dispute Resolution has been profoundly influenced by the internet, gradually evolving into the Online Dispute Resolution. At the same time, large sums of capitals invested on ODR and many Online Dispute Resolution platforms appeared. Because of these newly-emerged factors, the ODR platform is able to help us settle the dispute effectively, however, also brings us new risks. In this paper, based on two types of characters mentioned above, the author tries to analysis two dimensions of the risk of ODR platform. After that, the author suggests that, in order to better balance between freedom and security, a Polysystem of regulation on ODR platform should be established.
