Although control of lawlessness and maintenance of security is a venerated role of criminal law, yet since the September 11, 2011, attacks, the balance between heightened security policies and protection of human rights has become an important topic in legal circles today. In Germany security agencies seek to acquire ever wider powers to gather information. In contrast efforts geared towards limiting these powers have also been the subject of clearer judicial oversight in recent times. The author of this paper argues that the system established by the Federal Constitutional Court in Germany provides effective protection for fundamental rights. |
