This article analyzes movie reviews and their fair use of original movies. A reviewer’s use of the original movie may constitute copyright infringement. The only solution for the reviewer to avoid copyright liability is a fair use defense. This article suggests that a movie review should follow a standard recognized by academics or reach a work of aesthetic value. The review should not use too many clips or senses of a movie to avoid from being considered as a substitute of the original movie. Thus, the movie reviewer may enjoy fair use. Under that, AmoGood’s movie review may not enjoy fair use. AmoGood merely rephrases the script of a movie and uses many corresponding clips to form his review video. AmoGood’s movie review video is simply a short version of the original movie and a substitute thereof. Thus, a fair use defense may not be asserted successfully by AmoGood. |
