論木馬抗辯之基礎數位證據判斷──評高等法院臺南分院99年度上更（一）字第159號刑事判決

電腦、網路、電子簽章、雲端技術、電子書、智慧型裝置等各種型態載具中，充斥著各種型態的文件資訊，以數位化之方式呈現與儲存，這一種現象，是現代社會科技發展中的一種必然的趨勢，而且已經發展至與人類生活無可分割的程度。
木馬抗辯源自於惡意程式對於被害者電腦之控制，並以被害者名義進行其他犯罪行為。由於木馬攻擊事件層出不窮，木馬抗辯的發生也更形廣泛而常見。
只是數位證據之專業性，向為法院所缺乏者，更容易因為對於數位證據性質之錯誤認知，導致審判結果的錯誤。本文從一些法院判決審理的結果進行研析與探討其錯誤判斷之關鍵，進而作為未來法院審理相關數位證據時，能成為重要之參考依據。

Digital evidence differs from physical evidence in various aspects, therefore raising a number of important issues.
The Trojan horse defense attributes the commission of a cybercrime on a malware, whether a Trojan horse, virus, worm or other programs Due to the increasing use of Trojan programs by hackers, this defense is likely to become more widespread.
It is easy to make wrong judgments because the judges are not good at digital evidences. This essay will discuss some criminal cases and talk about why the judge made the wrong decisions. And I wish the conclusions and suggestions of the essay will help judges in analyzing digital evidences.
