我國再生能源政策與WTO協議衝突可能性之初步研究──以限定政府採購設備自製率比例與自產生質燃料補貼為中

The Preliminary Study on the Compatibility of Renewable Energy Policies with the WTO Legal Order, Focus on the Subsidies of Domestic Biofuels and Limitations on Government Procurements

為維持環境永續發展，2002年行政院經濟部研擬「再生能源發展條例草案」，其中涉及電價補貼與設備補助。我國身為WTO會員，因此對於我國再生能源政策限制設備與零組件之自製率需達一定比例，或補貼自產生質燃料所需之料源，需依照WTO之各項規範辦理。目前WTO之規範下，關於限定民間或政府採購再生能源設備或零組件之自製率比例，係可能違反補貼暨平衡稅協定與農業協定與政府採購協定等相關規範。另外，再生能源補貼政策，係需符合WTO農業協定與政府採購協定。本文之目的在於釐清爭議，尋求兼顧不違反WTO架構又能協助國內再生能源相關產業發展之可行措施，提供當局評估未來有關電價補貼與設備補助之政策是否酌予法制化。

In order to maintain sustainable development of the environment, in 2002, the Ministry of Economic Affairs drew up 'The Renewable Energy Development Act Draft', which involves the electricity price subsidy, the equipment subsidy and other forms of governmental support in domestic energy supply chain. As one of the WTO members, our country has to observe the WTO legal orders, therefore whether these domestic support measures would conflict with the WTO regulations, such as 'Agreement on Subsidies and Countervailing Measures', ' Agreement on Agriculture ', or ' Agreement on Government Procurement', should be considered by the authorities before adopting those domestic supporting measures in domestic energy supply. This article attempts to analyze whether those domestic support measure in energy department, in particular in renewable energy supply, would violate the WTO legal orders, and argues possible resolution as a suggestion to energy authorities in Taiwan.
