規範演進視角下的《民法總則》

General Part of Civil Code in the Perspective of Normative Evolution

儘管倉促通過的《民法總則》有諸多不盡如人意之處，但是，立足於規範演進的視角觀察，相對於原有規範，很多調整都更好地回應了現實的需求。具體規範調整的原因，是人們思想觀念的轉變。調整的目的，是為了以更合理的規範，匡正現實中的利益失衡。

There are some unsatisfactory respects when General Part of Civil Code was hastily passed. To observe it in the perspective of normative evolution, many amendments are better responsed to the real demand compared to old norms. The change of people's idea is the cause of norm amendment. The purpose of norm amendment is to rectify the imbalance of benefit in reality according to more reasonable norms.
