The Merits and Deficiencies of General Provisions of the Civil Law

《民法總則》的通過，表明我國在民法典的編纂工作進程中又邁出了堅實的一步，立法成果值得肯定。本文指出，《民法總則》在彰顯人文主義、明確習慣的法律淵源地位、建立成年人監護、構建財產權的平等保護、確立期待權、妥善安排《民法總則》與《民法通則》的關係等方面有諸多亮點，同時《民法總則》在規定民法的適用規則、民法解釋方法、國家的民事主體資格、非法人組織的登記制度等方面可能還存在一些缺憾。

The adoption of General Provisions of the Civil Law shows a solid step in the codification of civil code of China, and its achievement is worthy of credit. This article points out the merits of General Provisions of the Civil Law in various aspects, such as demonstrating humanism, confirming customary laws as the source of law, establishing guardianship for adults, constructing the equal protection for property right, protecting the expectation right, and combing the relationship between General Provisions of the Civil Law and General Principles of the Civil Law; at the same time, some deficiencies may remain in applicable rules and interpretation methods for the civil law, the qualification of civil subject of state, and the registration system for unincorporated organizations etc.
