《立法法》在民族自治地區施行的相關問題

Relevant Issues Concerning the Implementation of Legislation Law in Ethnic Autonomous Regions

2015年3月我國修改《立法法》，將“城鄉建設與管理、環境保護、歷史文化保護等＂地方立法權下放到所有設區的市，有力地促進了地方治理法治化的進程。在生態優美、民族文化豐富的民族自治區域，更是出現了城鄉建設與管理、環境保護、歷史文化保護等方面的立法熱，但也出現了立法滯漲、特色立法不夠等問題。以廣西壯族自治區為例，桂林、柳州、北海等設區的市在《立法法》實施後都獲得了地方立法權，但從這些設區的市目前所制定的地方性法規來看，主要是一些落實“城鄉建設與管理、環境保護、歷史文化保護等＂方面事項的行政管理方面的規定，而對少數民族生態環境權利、傳統文化權利保障的立法不多，這與《民族區域自治法》所追求的價值取向有所背離。這說明《立法法》在民族自治地區施行中，還需要在立法目的方面確立權力與權利的平衡觀，並協調好與《民族區域自治法》之間的關係。

There are problems like the stagflation of legislation and lack of local features in local legislation of ethnic autonomous regions. Few local regulations are on protecting environmental rights of the ethnic minorities and traditional culture. This contradicts with the value orientation of the Law on Regional Autonomy by Ethnic Minorities. We should balance power and rights in terms of legislative purpose, and adjust the relationship between Legislation Law and Law on Regional Autonomy by Ethnic Minorities.
