在新的起點上加強地方立法工作

Promoting Local Legislation from A New Start

地方立法是我國社會主義法律體系的重要組成部分，在建設中國特色社會主義事業中發揮著重要作用。隨著全面推進依法治國戰略的推進，中央賦予地方立法的權限逐步放開。黨的十八屆四中全會對立法工作提出了新要求，據此，2015年修訂的《立法法》對地方立法工作做出了新規定，賦予所有設區的市地方立法權。在新的起點上加強地方立法工作，基礎是要把握好地方立法的從屬性和自主性相統一這一特徵，關鍵是把握好地方立法的權限，重點落實於三個關係的把握：把握好與黨委、政府的關係；把握好與憲法、法律的關係；把握好省級與設區的市地方立法的關係。地方立法在新的起點上一定會得到進一步加強和改進。

Local legislation is an important component of socialistic legal system and contributes significantly to the building of socialism with Chinese characteristics. In order to promote the rule of law comprehensively, the Party Central Committee and government gradually release authorities of local legislation. The Fourth Plenary Session of The 18th Chinese Communist Party Central Committee set a new goal for legislation which made Legislation Law amended in 2015 introduce new provisions for local legislation, authorizing local legislation in all the cities with subordinate districts. To enhance local legislation from a new start, we should primarily balance the subordination and autonomy of local legislation. The key point is to control the limit of local legislative authority, and the main content is to coordinate with three kinds of relationship, including Party committee and government, Constitution and laws, provincial legislation and legislation in cities with subordinate districts. Local legislation will definitely receive further reinforcement and improvement from the new beginning.
