Unlike personal injury damages, wrongful death damages has long been denied by common law principles. In most common law jurisdictions, there was no common law right to recover civil damages for the wrongful death of a person. To alleviate the unfairness brought by the denial, most U.S. states enacted statutes to create a right to such recovery for the deceased’s survivals. Besides, most jurisdictions also enacted survival statutes that permits survivors to seek damages for claims that the decedent would have had, but for his death, as with a claim for pain and suffering between time of injury and death; the claim becomes an asset of the estate. Although nearly all U.S. states are equipped by the wrongful death statute and survival statute, the details of these laws are not identical. Each state has different attitude toward wrongful death claims. The article lays focus on issues regarding the differences and discussions are concentrated on some types of damage that are unseen in Taiwan’s civil laws. |
