日本對於電傳勞工勞動權益之保護－－兼論對我國建構相同制度之啟示

Labor Protection for Teleworkers in Japan: New Legislation in Taiwan?

近年來，由於資訊通信科技快速發展與電腦、網路等之普及，職場環境與就業型態隨之發生變化，勞工可藉著活用資訊通訊科技，於自宅或其他得使用網路等通信設施之場所提供勞務，而不受時間場所之限制，此即所謂的電傳勞動。然而，我國現行的勞動法制向來以直接管理所及之工作場所為主要規範對象，則現行法是否足以因應電傳勞動此種新的工作型態，即有予以檢視之必要因此，本文將以針對電傳勞工之勞動權益保障定有相關指引之日本法及美國法為比較法之對象，首先，說明日本關於電傳勞動權益保障指引之內容，並就電傳勞工勞動法上問題點加以探討。其次，對於美國法對於推動電傳勞動之相關立法及指引的內容加以說明後，檢討美國法上電傳勞動於勞動法上之相關問題。最後，針對我國應適用勞基法等相關勞動保護規定之勞工，檢視現行法制關於其權益之保護是否有未盡之處，並提出相關之建議。

With the development of information-technology, the new working style, telework, is becoming increasing popular. This article deals with the issues concerning labor protection for the teleworkers. First of all, the official guides to telework in Japan and the U.S. will be introduced and discussed. Second, based on the consideration that the current labor regulations have been focused on the traditional working style, whether the government needs to adopt a whole new approach for the teleworkers will be analyzed. Last, the basic need for the protection for the teleworkers will be briefly mentioned.
