從國際公約視角探討成癮性毒化物質對戰爭之影響

From the Perspective of International Law to Discuss the Effects of Addictive Substances on War

本文由1988年《聯合國禁止非法販運麻醉藥品和精神藥物公約》及1993年《關於禁止發展、生產、儲存和使用化學武器及銷毀此種武器公約》為基點，探討「成癮性毒化物質」於戰時運用之限制，是否可能存在國際規範上共通之原理原則。進一步藉由大規模毀滅性武器與生化武器，於戰時禁止或限制的國際法理念，導出戰時國際法對於成癮性物質規範的侷限性，包括武器使用對象、法益侵害類型及軍事運用合法性等面向。末以，結合當前因應恐怖主義與國際毒品販運的防制趨勢，歸納平時國際法對於成癮性物質之規範標準，作為戰時成癮性物質使用的禁限原則，避免成癮性物質於戰爭時期轉換為承平時期後遺留之濫用及國際社會危害。

The discussion of this article on the restrictions of addictive (poison) substances using in armed conflict through analysis of “Convention on the Prohibition of the Development, Production, Stockpiling and Use of Chemical Weapons and on Their Destruction (CWC)” and “United nations convention against illicit traffic in narcotic drugs and psychotropic substances”. Furthermore, we study “weapon of mass destruction” and “conventional weapons” to clarify matters of limitation of International Law in war time. This Essay advocate to apply international law in peace time to set norms of addictive substances using in military purposes.
