TPP中智慧財產權執法措施初探

《跨太平洋夥伴關係協定》在區域自由貿易協定發展的浪潮中備受矚目，其智慧財產權執行措施延續了《反假冒貿易協定》的“超TRIPs”強保護規則， 和《與貿易有關的智慧財產權協議》相比較在民事執法措施、邊境執法措施等方面均具有更高的標準，比我國相關措施更加詳細且嚴格，可能會改變國際智慧財產權保護制度，同時損害包括我國在內的多方權益。為了保障我國的海外利益，我國應抓住協定還在發展，相關措施並不成熟的有利時機，從對內和對外兩方面建立應對機制和策略，書寫中國規則。

Trans-pacific Parternship Agrement is high-profile in the wave of the development of the regional free tade agreements, the intellectual property enforcement of which continued the strong protection rules of Anti Counterfeiting Trade Agreement. Compared with Agreement on Trade Realated Intellectrual Property Rights, it has higher standards in term of civil enforcement measures, border enforcement measures, more detailed and stringent measures than China did in this respect. And it not only changes the international system of intellectual property protection, but also undermines the interests of developing countries in many ways. Of course, the Agreement also encountered resistence in the process of development. As for China, we should seize the favourable opportunity when the system of it is still developing and the relevant measures are not mature to estblish mechanisms and strategies, writing chinese rule in order to protect our interests abroad.
