Expanding and Renovating Chinese Ways to Ascertain Foreign Law

我國既有外國法查明途徑是改革開放初期創設的，現在已遠不能滿足我國法院適用外國法的需要，成為制約涉外民商事審判效率的瓶頸問題。在現階段，我們可以根據實際情況，依托法學院校創建多元的外國法查明研究中心，同時搭建法院系統自身的外國法查明平臺，為查明外國法開拓新途徑，提高查明效率。對於涉港、涉澳案件，也可以請求港、澳中聯辦協助查明香港法和澳門法。對於既有外國法查明途徑，應當加以規範和完善，繼續發揮其應有的作用，同時，對各種外國法查明途徑應加以整合，厘清其效力位階，構建多元、便捷、高效的外國法查明途徑體系。

The existing Chinese ways to ascertain foreign law were set up at the beginning of reform and opening up. But with the passage of time, they can't meet the needs of Chinese courts to apply foreign law, and has become a bottleneck for the trial of cases with foreign elements. At this stage, in order to expand new ways and improve the efficiency to ascertain foreign law, centers can be set up for foreign law study and ascertainment, and, at the same time, the mechanism of the court system be set up to ascertain foreign law. For the cases involving Hong Kong or Macao, we can take advantage of Hong Kong and Macao Liaison Offices to ascertain the law of Hong Kong and Macao. Current ways should be improved and ranked in respect of binding force, in order to build a harmonious system of ways to ascertain foreign law.
