The Study of Corporal Punishment and Student's Discipline in Primary School by a Case

學校行政工作和教學的工作是繁複沈重的，總是有忙不完的感覺，在忙碌工作時，學校學生若能體貼教師的辛苦，在品行和學業上表現優良，是所有教育人員的最大安慰；但是，事情總是沒有那麼盡如人意，面對校園中調皮搗蛋和惡形惡狀的學生，學校中的行政人員和教師該如何進行輔導與管教，是學校教育人員應該深入探討的問題。因為，每當重大校園事故發生後，學校教育人員可能因此違法，大家只能感嘆現代夫子之難為，現代學生之難管，而陷入茫然無措的窘境。本文從一個教師體罰的個案為出發點，開始討論其中的爭議焦點，進而討論國民中小學教師教學的自由和學生人權，並歸納專家學者的意見，整理出教師管教學生的原則和程序，並對教師輔導與管教學生辦法的特點加以討論，最後對國民中小學管教學生提出幾點建議，作為教育人員管教學生的參考。

Student's discipline is one of school's complex and busy works. To explore and realize corporal punishment event with a case study, teacher's right, student's right are the purposes of this study. Basing on front statement, to address principle and due process of student's disciple are second purposes of this study. Finally, it would offer suggestions of the study to schools' administrators and faculties for reference.
