英國禁止童工女工從事危險性有害性工作規定之探討

本文探討英國禁止童工女工從事危險性、有害性工作的保護法律與工作規定，這些規定乃依據歐盟指令，以公平就業原則、保護勞工安全健康與兒童和青少年等原則為基礎，介紹說明其法律規定之具體內容。公平就業原則的目的在掃除性別歧視；保護勞工安全健康原則在保護婦女在職場的安全健康，並孕育健康的下一代；保護兒童和青少年原則是為了保護兒童和青少年安全健康成長的同時，也能接受適當的工作訓練。此外，更進一步與我國相關法律比較，以作為我國修訂法律時的參考。建議我國修訂禁止童工女工從事危險性、有害性工作規定之法律時，除了參考外國較高的職業安全標準之外，也要配合本國產業的特殊性質，進行由下而上的基礎研究，瞭解本國危險性、有害性工作的種類與特色，俾建立實際有用的職業安全衛生環境。

This study is to investigate the work-related protective legislation and regulations for women workers as well as child labor from hazards and dangers in the United Kingdom. The European Community directives- based United Kingdom rules are introduced in this study. The purpose of the principle of equal treatment for men and women is to eliminate sex discrimination at work; the principle of protecting the health and safety of labor is to protect women workers from dangers; and the principle of protecting the child labor is to protect children and young persons as well as to educate them during their training at the same time. Moreover, recommendations are made in this study to improve working conditions for women workers in Taiwan. It is of great value to use the occupational safety standards and regulations developed in the industrialized countries as references. However, it must be pointed out that the industrial development history of Taiwan must be taken into consideration in the draft of new policies or regulations to protect women and child labors from dangers.
