Law, Trust and Property Management

從法律和信任兩個維度，運用比較經濟學的分析方法對我國當前居民小區物業管理糾紛頻發的原因進行研究後不難發現，在物業管理中大量地存在政府行為被市場行為的不當替代，以及政府行政管理退出後，相關配套法律制度供給呈現嚴重不足的情形；而當代中國社會所普遍存在的信任危機，使得業主和物業管理公司難以擺脫“維權難”、“治理難”的雙重困境；同時，由於市民資本運作意識缺位，進一步加劇了物業管理中信任危機的頻度和力度，進而阻礙有效的溝通與合作。要建立順暢的物業管理秩序就必須儘快改善法律的制度供給，重建各方信任關係。

Analyzing the reasons of property management disputes frequently happened in current China by employing comparative economics approach from the dimension of law and trust, it is not hard to find out that government's role has been replaced by market force improperly and that relevant legislations are in serious short supply with the withdrawal of administrative force from government side. Additionally, the prevalent crisis of trust in current China makes it difficult for both property owners and property management companies escape from the double dilemma of maintaining lawful rights and ensuring proper governance. In the meantime, due to the lack of financial awareness of common citizens, the frequency and intensity of the trust crisis in property management have been accelerated, thus greatly hindering the effective communication and cooperation of both sides. Improvement in legislation supply and reconstruction of mutual trust are needed for the establishment of smooth property management order.
