信息公開與政治公議的合法化展開－－一種關於“網絡謠言”的憲政主義解讀及解決思路

The Constitutional Logic of Information Disclosure and Political Deliberation

當下圍繞著“公意主題事件”而生成的“網絡謠言”，多為公民基於參與公共政治的聯動機制而形成的信息求索機制，屬於公民權利的憲法機能形式。它在填補公民參與公共政治的信息赤字的同時，為建構良性的官民互動和公信機制提供了充分契機。伴隨著互聯網所建構的平面化信息交流機制的日益深入，以及開放、透明的公共信息機制需求在現代國家的民主政治建設中的作用日益凸顯，制度設置必須提供更為開放和多元的信息交流機制，尤其是公民參與政治的公共信息獲取路徑。因此，需要闡明互聯網上的信息生成和傳遞作為國民公共信息獲取程式的必要性，澄清政治公議的憲法化展開邏輯，為“網絡謠言”所犯政法禁忌解套，實現借助互聯網有別於官方話語系統的政治公議的常態化和合法化，並最終尋求其正當性的法理根基。

Cyber Rumor, which comes from the popular-focus-on-accident, is mostly the information acquisition process that starts from the process of citizens participating in public politics and belongs to the constitutional mechanism of civil rights. Cyber Rumor provides a great chance for constructing the excellent ofifcial-citizen reaction and co-trust institution, in the mean times, it fills the information deficit when the citizen participate in politics. In the course of planarization mechanism of information communication constructed by internet, when the demand of public and transparent information mechanism becomes an increasing prominent role in the democratic politics construction of modern country, institutional arrangement must provide a more open and plural information communication mechanism, especially in the information acquisition method of civil political participation. Therefore, this essay discusses the necessity of information formation and transmission through internet as a stigma of citizen’s acquisition information, clarifies the constitutional logics of political discussion and untangles the political taboo violated by cyber rumor with the purpose of normalizing and legalizing the political discussion which differentiates the ofifcial utterance through internet. In the end, this essay wants to build a jurisprudential foundation of the legitimation of cyber rumor.
