FRAND標準必要專利許可使用費的計算，必須進行反專利劫持、反專利許可使用費堆疊、平衡專利權人和標準實施者的利益等政策考量，不應當採用過分簡單的比較方法進行，可以借鑒“微軟案”採用的假設性雙邊協商方法。

The Calculation of FRAND SEPs licensing royalty should take anti-hold up, anti-royalty stacking and the balance of patent holder’s and standard implementer’s interests into consideration. The calculation should not use over-simple comparison approach, but could use the hypothetical negotiating approach of software case’s judgment for reference.
