知識產權的“去中心化”－－比特幣與登記制度

The Decentralization of IP: Bitcoin and the Register System

在全球化和互聯網所構筑的社會經濟新秩序中，傳統的產權框架面對消解了民族國家的世界秩序，已經無法有效解決其帶來的新問題。當知識產權在新秩序中將自身權利通過登記制度和國際貿易擴散到全球，登記制度也就蛻變成了一種“霸權”力量。對於貨幣產權的霸權，比特幣的興起及其提出的金融“去中心化”是對這一問題的直接回應。將比特幣“去中心化”的產權確立的機理延伸到知識產權的領域，也就呼喚了知識產權的“去中心化”，以超越登記制度所建立起的知識產權確立框架，從而回應新秩序的挑戰。

In the new social-economic orders which established by the globalization and the internet, the traditional world of national-states have been vanished, thus the old fashion of property rights fail to resolve those new troubles brought by the new order. The IPRs in this new orders then able to spread it self’s justification of the foundation of right through the register system all over the world. The register system, under this condition, have been transformed into some kind of power of hegemony. The Bitcoin and the decentralization of finance in the cyberspace is the most important resist to the hegemony of money. Follow the trend of Bitcoin and the decentralization of property, the decentralization of IPRs is inevitable. In order to overcome the troubles in the new order of globalization and the internet, the decentralized IP which beyond the register system is necessary.
