The Outline of Legal Issues of Internet Finance: From the Practical Perspective of Financial Enterprises

時下國內最熱門的話題莫過於“互聯網金融”，究其原因主要是因為互聯網金融不僅關涉政府部門、金融機構或互聯網企業，也正在改變著社會的方方面面，包括思維方式、行為習慣和商業模式。當變革帶給我們巨大便利和實惠的同時，紛繁复雜的互聯網金融模式也留下了各種問題和爭論，然而，在互聯網金融發展的初期，法律層面的問題是我們首先需要面對和解決的。以實務的視角來看，互聯網金融區別於傳統金融的特徵在於金額小、人數多、總量大和涉及面廣，因而需要我們樹立開放、包容和創新的理念，去探索適合互聯網金融的法律規範模式。

At present, the issue of internet finance is a hot topic in China. This is mainly because internet finance is not only a matter for the government, financial institutions and the internet industry, but also is changing many aspects of society, including the way of thinking, behavioral habits and business models. This change has brought us huge benefits, while at the same time it has given rise to many problems and debates due to the complexity of various models of internet finance. However, at the beginning of the development of internet finance, what are the legal issues involved should be solved firstly. Therefore, from the perspective of internet finance to examine practical legal issues, we believe, internet finance is different from traditional finance in that it is small in the value of any single transaction, but big in the number of people involved and hence large overall value and wide impact. This requires us to be open-minded and innovative in exploring suitable ways to solve the various problems with internet finance.
