論《核安全法》與《原子能法》的關係

Research on the Relationship between Nuclear Safety Act and the Atomic Energy Act

國務院通過的《核安全與放射性污染防治“十二五”規劃及2020年遠景目標》提出，要抓緊研究制定原子能法和核安全法。國際法的要求和各國的立法實踐表明，同時推進這兩部法律的立法工作不存在法律障礙。在我國還沒有一部專門規定核能產業發展與核安全方面內容的法律的情形下，同時推進兩部法律的立法工作，解決“無法可依”的局面勢在必行。但鑒於兩部法律可能存在的內容重疊和交叉情況，正確處理這兩部法律的關係對明確我國核安全立法的定位尤為重要。

The “Twelfth Five-Year Plan and the 2020 vision of nuclear safety and radioactive pollution prevention” passed by State Council requires that the Atomic Energy Act and the Nuclear Safety Act should be started to research and develop at the same time. It proved that promoting the legislation of these two acts simultaneously is imperative when China has not yet developed a specific act on nuclear industry and nuclear safety. However, there may exist conflicts between these two acts, properly handling the relationship between them is very important.
