The New Property

一個主要看重物質福利的社會中，政府開始成為財富的主要源泉，政府供給的財富逐漸取代傳統形式上的財富，個人的財富也越來越多地依附於政府。由政府供給產生的新型財富逐漸取代了傳統的私人財產權，有此也產生了一系列獨特的法律制度，這些新興的制度帶來了公共利異國家的興盛，也帶來了巨大的危險性。政府供給的增長造成的權力膨脹對個人獨立造成了極大的侵蝕，並阻礙個人用《權利法案》保護自己。此外，私主體還常常利用政府權力，以達到私人目的。這種私人依附於政府，有條件地接受供給並履行一定義務的制度與西歐的封建主義極其相似。公共利益國家，在某種意義上，代表了社會對私有財產權的勝利。然而，公共利益不能證明現存政府供給制度對自由的侵蝕。面對強大的政府權力我們更有必要為個人自由構建一個精神家園。為此有必要通過憲法限制、實體限制和程序保障來限制政府權力，但更重要的是將供給轉化為權利－－新財產權。

In a society which places emphasis on material welfare, the government has become the main source of wealth. Traditional forms of wealth have gradually been replaced by the property supplied by government, and personal wealth more and more depend on the government. Hence there arise a series of unique legal systems, which bring the power of the public interests oriented country as well as a grate of danger. The expansion of the power caused by government supply produces great damage on the personal independence, and goes against the use of The Bill of Rights. In addition, private person always uses the government power to achieve his private purpose. Such a system is similar to the feudalism of Western Europe. Public interests oriented country, in a sense, represents a victory of society for private property. However, it can't justify the damage caused by the government supply to the freedom. Facing the government power, we must build a spiritual home for the personal freedom. Therefore, it is necessary to limit the government power through constitutional constraint, substantial restrictions and procedural safeguards, however the most important is to transform the government supply into a new property.
