民法法典化、法典解構化及法典重構化－－二百年民法典發展歷程述評

19世紀理性主義民法典的產生有其特定的社會和思想基礎。但由於自身的固有局限，隨著時代的發展，這類民法典不可避免地呈現出解構化的樣態。但這並不意味著法典化時代的終結。伴隨法典解構化進程而出現的各種類型的法典重構化運動昭示著民法典的編纂理念進入了實用主義的新時代。

The codification of the idealized civil code of 19 century has its specific social and ideological background. Due to the intrinsic limitation of its self, these civil codes suffer inevitablely from the destiny of decodification with time, going on. However, it doesn’t follow that the process of codification is dying out. The recodification movement of one kind or another against the decodification process indicates the codification idea of civil code has been turning into the pragmatism suitable to the need of the new era.
