債權保障理論初探

本文旨在考察債權保障及其相關制度。文章認為債權保障包括債權實現的保障與債權存續的保障；債權效力是債權保障的內在動力，法律賦予的債權效力有請求力、執行力、依法自力實現、處分權能和保持力等。文章具體分析了構成債權保障制度的各項制度。鑒於責任財產制度在保障債權方面的關鍵地位和作用，本文特別對責任財產的概念作了辨析，並區分了責任財產的類型。文章結論部分闡述了各種債權保障制度之間的關系。

This article aims at researching the protection of creditors’rights and it’s relevant systems. Protection of creditors’rights includes two aspects: one is the protection for the realization of creditors’rights, the other is the protection for the existence of creditors’ rights. Validity of creditors’ rights is the internal force of the security of creditors’ rights, and it covers validity of request, enforcement, maintenance and so on. Presenting these contents, the author pays more attention to the detailed analysis of all sorts of systems making up system for the protection of creditors’rights. Considering the important role that responsibility property system played in the protection of creditors’ rights, the article makes an explanation for it and then teils it’s different types. In the conclusive part, it summarizes the relationship among kinds of systems for the protection of creditors’ rights.
