中非雙邊投資條約存在的問題及完善

China-Africa Bilateral Investment Treaties: Problems and Improvement

目前中非之間已生效的雙邊投資條約的數量還十分有限，落後於中非之間投資的迅猛發展。特別是，這些條約的內容還非常簡單，未能反映國際投資條約發展的新趨勢，對一些具體事項的規定還存在許多不足與漏洞。中國有關部門應考慮與更多非洲國家簽訂雙邊投資保護條約，並積極推動已簽署的雙邊投資保護條約生效。在簽署新的條約或修訂現有條約時，應考慮國際上投資條約發展的趨勢，並結合中非投資的實際情況，對相關事項作出明確規定或予以修正。

Currently the number of China-Africa BITs that have come into effect is limited, lagging behind the great increase of bilateral investment between China and Africa. Particularly, the contents of these BITs are quite simple and did not pay much attention to the current trends of BITs. Some deficiencies and gaps can be found in some provisions. The relevant authorities in China should consider concluding more BITs with African countries and work hard to put the ineffective BITs into effect. While concluding new BITs or revising the old BITs, account should be taken of the current trends of BITs and the particularities of China-Africa investment.
