This Article explores the concept of bribery by public officials, aiming to clarify the theoretical developments and problems and the practice of the Supreme Court in Taiwan. In the first place, this Article scrutinizes the arguments concerning the concepts of “abstract official authority,” “malfeasance closely related to official duties,” and “substantive influence.” Furthermore, this Article analyzes the theoretical framework of the Supreme Court precedents that do not invoke the concept of “substantive influence.” Based on the analysis, this Article endeavors to criticize the trend of adopting the concept of “substantive influence” by the Supreme Court in Taiwan. |
