公務員賄賂罪中的職務行為——以我國最近之學說與最高法院實務為中心

On the Concept of Official Duties in Bribery: Focusing on the Recent Theories and Practice of the Supreme Court in Taiwan

本文以我國公務員賄賂罪中的職務行為概念為主題，探討我國學說與最高法院實務的現況及問題。本文考察我國多數學說採取之「抽象職務權限」、「職務密切關聯行為」概念內容與問題，以及學說對最近實務上採取的「實質影響力」概念的爭議。本文也嘗試分析出我國最高法院在未採用「實質影響力」概念時判斷職務行為的理論構造與具體範圍，並以此為基礎，對近年來我國最高法院實務中受採用之「實質影響力」概念進行理論的檢討、評價，並在最後就公務員賄賂罪中的職務行為判斷嘗試指出解釋論上可能的基本方向。

This Article explores the concept of bribery by public officials, aiming to clarify the theoretical developments and problems and the practice of the Supreme Court in Taiwan. In the first place, this Article scrutinizes the arguments concerning the concepts of “abstract official authority,” “malfeasance closely related to official duties,” and “substantive influence.” Furthermore, this Article analyzes the theoretical framework of the Supreme Court precedents that do not invoke the concept of “substantive influence.” Based on the analysis, this Article endeavors to criticize the trend of adopting the concept of “substantive influence” by the Supreme Court in Taiwan.
