我國濕地生態補償立法探究－－以鹽城濕地為典型案例

The Research on Chinese Wetland Ecological Compensation Legislation: Yancheng Wetland Analyzed as a Typical Case

我國濕地保護與經濟發展之間的矛盾日益尖銳，建立適應不同地區的統一的濕地生態補償機制是實踐發展的迫切需要。濕地生態補償的理論依據主要來自於產權理論、公共產品理論和外部性理論。我國濕地生態補償立法應堅持污染者賠償、受益者補償、公平和可持續發展的原則，對濕地生態補償主體的權利義務進行規制，從濕地生態補償管理部門、補償範圍、補償方式和補償資金四個方面進行建構。

The contradiction between the wetland protection and economic development in China is acute, so it is an urgent need to establish an unified wetland Eco-Compensation mechanism. The primary theoretical basises of the wetland Eco-Compensation comes from the property rights theory the public product theory and the externality theory. Our country’s wetland Eco-Compensation legislation should adhere to the principles of polluter-pays beneficiary compensates fair and sustainable development and regulate the right and obligation of the wetland Eco-Compensation subjects. Moreover, it should be constructed from four perspectives: the administrative department compensation range mode and funds.
