俄羅斯“組成統一工藝的智力活動成果利用權”制度

The System of ‘the Right of Using Intellectual Activities Outcome in the Formation of the Unifying Technology’ in Russia

通過靜態與動態兩種方式對俄羅斯“組成統一工藝的智力活動成果利用權”制度進行了全面的闡釋與分析，明確了其名稱、概念、特徵等相關問題，並界定其為國家財政投入的科學技術成果轉移制度，進而在此基礎上將其與美國《拜杜法》、我國《科學技術進步法》第20條對比分析，確定其對應到我國《促進科技成果轉化法》中，應為某一項具體的措施規定。

This article explains and analyses this Russian system comprehensively in both a static and dynamic way, making clear some of its related issues such as its name, concept, features and so on, defining it as a transfer system of scientific and technological achievements which are invested by national finance. Grounded in the content above, this article compares this system with the Bayh-Dole Rule in America and the Article 20 of Science and Technology Advancement Law in China, confirming that it may correspond to a specific rule in China’s Promoting Law on Scientific and Technological Achievements.
