我國「外勞（客工）」的勞動人權與社會保障：兼論勞保條例之適用與檢討

The Rights and Social Security of ＂Foreign Labors (Guest Workers)＂: Examination of Applications of Labor laws

從現代國家治理的角度來看，特別是勞動力的輸入國而言，不僅外國人勞動力的開發與管制（行政）已是其內國勞動市場政策的一環，對於外國人勞工的權利如何確認並予以保護，更是其國家展現其文明發展與人權價值的重要指標。因此，本文主要探討在於檢視我國外國人勞工，尤其是藍領「外勞」於我國現行勞動法與社會（保障）法體制下之保護適用情形。基此，並參照主要國際勞動與社會法公約以及鄰國日本，其有關外國人勞工的權利保護等相關制度之實施經驗，並以此反省我國現行制度的缺失與困境，期待得作為我國日後立法政策上之比較參酌。

From the managerial perspective of modern countries with imported labor force, the development and control of foreign labor force has been an essential part of labor market policy. The recognition and protection of foreign labors' rights are also important indicators that reflect the countries' civility and humanity. This study specifically examined the conditions of the current labor laws and social security that apply to the blue collared foreign labors. While examining the defects and difficulties of the current domestic policies, the international labor and social agreement, as well as Japanese government's practical experience in protecting rights of the foreign labors were referred in order to make the future relevant legislation.
