台湾法文化研究のあり方──日本法を手掛かりに

A Note on the Research Agenda for the Studies of Legal Culture in Taiwan: Implications of Japan's Orientation and Themes

本文針對現今臺日兩國學界之法律文化（Legal Culture）研究動向作一整理與探討。目的在藉由日本學界的研究方法對臺灣的法律文化研究應有方向與課題提出建言，並以此作為筆者從事臺日法律文化比較研究之先行研究一環。經由本文探討得知，日本的法律文化研究經過川島武宜等學者的努力與倡導，已成為日本法律社會學界主要課題之一。相對之下，臺灣方面雖有臺大法學院臺灣法制史專家王泰升教授等法學者開始注意到法文化研究此一範圍，然筆者認為尚待努力的空間甚大。本文在探討臺日法律文化研究之現況後，建議今後臺灣的法律文化研究當以臺灣為主體，從事比較法律文化之研究方向，並提出自臺灣法制史學以及法律社會學角度之研究課題。

This essay studies the present research agenda of legal cultures in Taiwan and Japan. In Japan, the legal culture is one of the central themes in the Japanese academic communities of the Sociology of Law. In contrast, in Taiwan, the relevant research has been assumed by scholars specializing in Taiwan legal history. The author argues for the necessity of Taiwan centered study on Taiwanese legal culture, and suggests several research themes from the perspective of Taiwanese, legal history and sociology of law to further the development of the legal cultures studies as an independent academic field in Taiwan.
