There is a new trend in the Taiwanese environmental movements: using litigation to achieve their goals. There are several factors which have facilitated the new trend. They include the crisis of the legality of an Environmental Impact Assessment, the decline in the mobilization of social movements, judicial independence, and the appearance of environmental lawyers. Although environmental lawyers and social movement organizations have won several lawsuits, the impacts of victories in courts are limited. The major obstacle faced by the judiciary as a dynamic of social reform is the resistance from the executive. |
