我國非法證據排除規則問題研究

ON THE QUESTIONS OF EXCLUSIONARY RULE IN CHINA

2012年刑事訴訟法修改增加的非法證據排除規則實施一年多來有許多經驗可以總堂，本文研究了我國非法證據排除規則實施以來存在的若干重大問題，包括非法證據的范圍、非法證據排除的操作程序、非法證據排除的證明責任、非法證據排除的認定標准等，毒樹之果是否排除等等，並對完善我國非法證據排除規則作出了具體建議。

The revised Criminal Procedure Law has , for the first time, prescribed China’s exclusionary rule. Theoretical studies and discussions on the problems of implementing the exclusionary rule during the past year are in urgent need. This article studies the important issues that appeared in the implementation of the exclusionary rule, including the scope of illegal evidence, the operating procedures of the exclusionary rule, and the burden and standard of proof in excluding illegally obtained evidence, and suggests some measures to promote the comprehensive understanding and implementation of the exclusionary rule in China.
