ON THE DEVELOPMENT OF LAWYER PROFESSION IN CHINA

中國律師業發展研究

在1957至1977二十年政治沖擊下消亡的中國律師業，在改革開放后得到了蓬勃發展，尤其是1996年＜＜律師法＞＞制定之后，發展更為迅猛。然而，在中國律師業前進過程中，發展與隱憂並存。本文從縱向和橫向兩個角度入手，總結中國律師業在通往職業化發展道路上的成績與曲折，並對中國律師職業目前行政化色彩濃重、自治力弱、職業化程度有待提高等問題了建議。同時，鑑於律師執業責任是律師職業化發展過程中不可迴避的問題，本文還就律師的執業責任進行深入探討和分析。

After the abolishment of lawyer professions from 1957 to 1977 because of political circumstances, the lawyer profession have developed very fast since the Reform and Opening up , especially after the enactment of the Lawyer Law of the People’s Republic of China. However, achievement and hidden problems exist side by siede during this process. This article therefore aims to provide further research on the lawyer profession, how it has moved its way to a more professional career, what its achievements and concerns are. This article hopes to give more attention to the hidden problems of this profession, such as the entrenched favor toward administrative power, the still weak self－regulation, and attempt to give some suggestion for its future development. Moreover, the professional liability of lawyers will also be discussed, as it is an unavoidable part of a lawyer's career during his or her way toward professionalization.
