駁「南海版」的「中國威脅」論——從史實和法理看中國對南海諸島擁有主權及中國對外和平交往政策

Refuting So-called「China Threat」Doctrine in the South China Sea: China's Sovereignty over Islands and Reefs in the South China Sea and Its Peaceful Foreign Policy from the Perspective of History and Jurisprudence

在2014年「仁愛礁事件」和「中越西沙石油鑽井平台衝突」上，美國誣稱中方行為屬挑釁行為，加劇了緊張局勢。此類讕言，可概稱為「南海版」的「中國威脅」論。這類爭議的實質是對南海島礁周圍海域自然資源以及航道利益所帶來的經濟利益之爭，其取決於南海諸島主權問題的解決。從史實、國際法時效及佔領的角度來說，中國對南海諸島擁有不可爭辯的主權。從鄭和七下西洋、萬隆會議、中國對越、菲的援助以及鄧小平「擱置爭議、共同開發」的提議來看，中國一直奉行對外和平交往政策。這表明中國願意在堅持南海諸島主權的基袖上，以和平方式解決南海爭端。然而在事關主權和領土完整的重大原則問題上，中國不惹事，但也不怕事。

On the issues of the Ren'ai Reef incident and the operation of the HYSY 981 Drilling Rig in 2014, U.S. State Department Spokespersons said that China's action were a provocative activities that raises tensions. We could call such calumnies as「China threat」doctrine on the South China Sea. The nature of such disputes is to gain economic interests of nature resources and shipping lanes in this areas, which is depending on the settlement of disputes over sovereinty of islands and reefs. From the pespective of history, prescription and effective occupation under international law, China has indisputable sovereignty over islands and reefs in the South China Sea. According to cases of Zheng He leading seven maritime expeditions to the Western Seas, the Bandung Conference, the assistance of China to Vietnam and the Philippines, as well as the principle of shelving disputes and joint development suggested by Deng Xiaoping, China have been pursuing foreign policy of peace, which shows that China is willing to resolve the South China Sea disputes peacefully, on the basis of Chinese sovereinty over islands and reefs thereof. But on the fundamental issues of principle concerning China's sovereignty and territorial integrity,「even china really」do not stir up trouble, but「never be」timid.
