歐盟第四次知識財產權邊境保護立法及其對我國貿易的壁壘性影響分析

The Fourth Regulation on the IPRs Border Protection of the EU and Its Barrier Effect on the Sino-EU Trade

自20世紀80年代至今，歐盟共進行了四次區域層面的知識財產權邊境保護立法。2013年歐盟第四次頒佈了知識財產權邊境保護條例，與其第三次立法相比，取得了十項進展，進而將歐盟邊境保護制度推向了新的高度，並通過程序制度創新變相跨越了歐盟知識產權實體法不統一對邊境執法所造成的障礙，提高了歐盟邊境執法的效率。歐盟第四次智慧財產權邊境保護的高標準立法和歐盟海關的高強度主動執法對我國對歐貿易產生了更為隱形、更難跨越的貿易壁壘。

Since the 1980s, the EU enacted four regional legislations on IPRs border protection. The EU enacted the fourth version of IPRs border protection regulation in 2013. In comparison with the third regulation, the 2013 regulation made ten progresses, and then drove the EU's IPRs border protection to a new height. Meanwhile, through the innovation of the enforcement procedure, the new regulation overcame barriers to border enforcement caused by disunity of substantive IP rules, and promoted the efficiency of its IPRs border enforcement. The resulting rigorous standards of IPRs border enforcement of the Fourth Regulation have been producing hidden barriers to and significant negative impact on the Sino-EU trade.
